נישואים חד־מיניים שוב עומדים בימים אלה במרכז השיח הציבורי, ונדמה לי שחשוב להבהיר מהי בעצם השאלה ההלכתית העומדת בפני רב שזוג חד־מיני פונה אליו ומבקש את עזרתו ותמיכתו בדרך לחיים משותפים.
אקדים דבר פשוט: אינני מבקש לטשטש את הקושי ההלכתי, ובוודאי לא לטעון שטקס דתי הופך את האסור למותר. האיסורים ההלכתיים קיימים, וצריך להתייחס אליהם במלוא הרצינות.
וגם כאן, התמונה ההלכתית איננה בהכרח חד־ממדית. יש מקום לטעון שלא כל ביטוי של אינטימיות חד־מינית כלול באיסור התורה, בבחינת דיו במה שאסרה תורה. אבל גם מי שאיננו מקבל את הטענה הזאת עדיין צריך לשאול מהי המציאות הממשית העומדת בפניו ומה נכון לעשות לנוכח מציאות זו. פסיקה הלכתית אינה נעשית בחלל ריק; היא צריכה להביא בחשבון גם את תוצאותיה של הכרעה זו או אחרת.
וזו הנקודה שחשוב לי לחדד:
זוג גברים שפונה לרב ומבקש ממנו ללוות אותו בדרך לנישואים איננו שואל את הרב אם להיות זוג. גם אם הרב יסרב, הם לא יחדלו להיות הומואים, וברוב המקרים גם לא יחדלו לחיות כבני זוג. סירובו של הרב איננו יוצר חיי פרישות.
לכן הברירה המעשית איננה בין נישואים חד־מיניים לבין התנזרות מחיי אישות. השאלה היא איזה אופי יהיו לחיים הזוגיים שכבר עומדים להתקיים: האם הם יתקיימו מחוץ למסגרת קבועה ומחייבת, או בתוך קשר של נאמנות, בלעדיות, אחריות ודאגה הדדית.
וכי לא זה, במידה רבה, אחד מתפקידיהם המרכזיים של נישואים גם בין איש לאישה?
אנשים אינם נישאים רק כדי לקבל היתר לחיי אישות. הם נישאים כשהם מבקשים לבחור באדם אחד, לעבור מחיי ארעי לחיי קבע, ולקשור את חייהם זה בזה מתוך נאמנות, אחריות ודאגה הדדית.
וכאשר זוג חד־מיני מבקש גם מסגרת דתית, אין הכוונה בהכרח לקידושין במובנם ההלכתי הקלאסי. אפשר לחשוב על טקס הלכתי אחר, שאיננו מבקש לשנות את גדרי הקידושין, אלא למלא חלק מן התפקידים שהם ממלאים: לתת לקשר צורה פומבית ומחייבת, ולבטא את הרצון שגם החיים הזוגיים הללו לא יהיו מנותקים מן הקב״ה ומעבודת ה׳.
ולפחות כפי שאני מבין את הדברים, עצם יצירתה של מסגרת כזאת איננה צריכה להיחשב לדבר אסור. השאלה היא כיצד לעצב אותה ביושר הלכתי, בלי לטשטש את הגבולות ובלי לייחס לה מעמד שאין לה.
כאן צריך, בעיניי, להבחין בין שתי שאלות.
האחת היא מהם הגבולות ההלכתיים של הקשר ושל הטקס. זו שאלה רצינית ומורכבת, ואסור לטשטש אותה.
השנייה היא: בהינתן שהזוגיות קיימת, האם יש ערך בכך שהיא תהיה קבועה ולא מזדמנת וששני בני הזוג יקבלו על עצמם אחריות עמוקה זה כלפי זה?
בעיניי, יש בשאיפה הזאת ערך הלכתי ודתי ממשי, וראוי להכיר בו ואף לעודד אותו.
אפשר וצריך להתווכח על גבולותיו ההלכתיים של הטקס. אבל עצם הרצון לעבור מחיים מיניים שאין בהם מחויבות בלעדית לחיים של קביעות, נאמנות ואחריות, ואף לבקש שהקב״ה יהיה נוכח בהם ככל שההלכה מאפשרת, הוא בעיניי רצון דתי חיובי.
זהו מהלך שראוי לנו, כרבנים וכקהילה, לסייע לו ולתת לו מקום בתוך עולם של תורה וקדושה.

Clarification!
Same-sex marriage is once again at the center of public discourse these days, and it seems to me important to clarify what the actual halakhic question is that a rabbi who is approached by a same-sex couple for help and support on the path to a life together is facing.
Let me start by saying something simple: I do not seek to obscure the halakhic difficulty, and certainly not to claim that a religious ceremony makes the forbidden permissible. The halakhic prohibitions exist, and they must be treated with the utmost seriousness.
Here too, the halakhic picture is not necessarily one-dimensional. There is room to argue that not every expression of same-sex intimacy is included in the Torah’s prohibition, as if it were a mere reflection of what the Torah forbade. But even those who do not accept this argument still need to ask what the actual reality is that they are facing and what is right to do in the face of this reality. A halakhic ruling is not made in a vacuum; it must also take into account the consequences of one or another decision.
And this is the point that I want to emphasize:
A couple of men who approach a rabbi and ask him to accompany them on the path to marriage are not asking the rabbi whether to be a couple. Even if the rabbi refuses, they will not cease to be gay, and in most cases they will not cease to live as a couple. The rabbi’s refusal does not create a life of celibacy.
Therefore, the practical choice is not between same-sex marriage and abstinence from married life. The question is what character the married life that is about to take place will be: will it take place outside a permanent and binding framework, or within a relationship of loyalty, exclusivity, responsibility, and mutual concern.
And isn’t this, to a large extent, one of the central functions of marriage between a man and a woman as well?
People don’t get married just to get permission to live married life. They get married when they want to choose one person, move from a temporary life to a permanent one, and tie their lives together out of loyalty, responsibility, and mutual concern.
And when a same-sex couple also requests a religious framework, they are not necessarily referring to kiddushin in the classical halakhic sense. One can think of another halakhic ceremony that does not seek to change the boundaries of kiddushin, but rather to fulfill some of the functions they perform: to give the relationship a public and binding form, and to express the desire that this married life also not be disconnected from Y-HWH and the labor of Y-HWH [indigenous mitzvot adherence].
And at least as I understand it, the very creation of such a framework should not be considered forbidden. The question is how to shape it with halakhic integrity, without blurring the boundaries and without attributing to it a status it does not have.
Here, in my opinion, we need to distinguish between two questions.
One is what are the halakhic boundaries of the relationship and the ceremony. This is a serious and complex question, and it is forbidden to blur it.
The second is: Given that the relationship exists, is there value in it being permanent and not casual and in both partners accepting a deep responsibility for each other?
In my opinion, this aspiration has real halakhic and religious value, and it should be recognized and even encouraged.
One can and should debate the halakhic limits of the ceremony. But the very desire to move from a sexual life in which there is no exclusive commitment to a life of permanence, loyalty, and responsibility, and even to ask that Y-HWH be present in it to the extent that halakhic law allows, is in my opinion a positive ethno-religious desire.
This is a move that we, as rabbis and as a community, should assist and give it a place within a world of Torah and sanctified living.

It’s explained by our Jewish people’s elders that, even after passing away, a devoutly evil person doesn’t lose his “worldly” desires – or his thoughts, speech, or actions in this world. It all goes with him. Therefore, when he goes to shamayim, those improper “clothes” remain attached to this soul, and this soul cannot remove them.
Therefore, to break that klipa, the evil person is thrown down into a world of imagination, where he imagines that he is still alive and does all those things which he did back in this world. However, in that world, one cannot remove those garments (unlike here, when one can arouse a love of ha’Shem by doing a sacred mitzvah, even after doing such evil business, etc.) and this inability to shed the past results in great pain for the evil soul (it knows what G-dliness is, and wants to attach itself but can’t).

Mark Twain visited the Holy Land in 1867 and described it as desolate and barren. The population was around 170,000: Arab tenant farmers, Bedouin, and Jews. In the late 19th century, the Zionist movement began restoring a homeland for Jews, investing billions (in today’s value) to legally purchase land from Arab landowners — mostly Syrian and Turkish families under the Ottoman Empire. Those land records are still on display in Tel Aviv.
From the 1890s onward, hundreds of thousands of Arab and Jewish workers poured in to build Tel Aviv, rebuild Jerusalem and Jaffa, and take advantage of the booming economy. 1918 marked the end of the Ottoman Empire’s colonial occupation of Palestine and the wider region. The British Mandate followed, along with the end of the jizya tax on non‑Muslims.
The Arab population was split between moderates who worked with Jews and those still aligned with the defeated Ottoman order, insisting on Jewish submission. The British appointed Kamel al‑Husayni in 1918 and his half‑brother Mohammad Amin al‑Husayni in 1921 as Mufti — a powerful position. The Husseini family was wealthy, influential, and virulently anti‑Jewish immigration. Ironically, they sold huge tracts of land to Zionist Jews while publicly opposing Jewish presence.
The followers of Mohammad Amin al‑Husayni form the ideological roots of today’s Palestinian nationalism. His campaign of violence began in 1923. He banned Jewish immigration (with British approval), organized the 1936 Arab revolt, and later collaborated with Nazi Germany — a violent extremist regime responsible for mass atrocities — in its goal to exterminate Jews.
The British facilitated the creation of multiple Muslim-majority states in the region. But when it came to the Jewish state, they stalled, reneged, and ultimately left the region in chaos. In 1947, conflict erupted again, culminating in the establishment of Israel. Roughly half of the Arab population left — many voluntarily, many due to defeat — later rebranded as the Nakba.
In 1948, five Arab armies invaded and were defeated. Egypt annexed Gaza; Jordan annexed Judea and Samaria until 1967. In 1964, under Yasser Arafat’s direction, the Arabs in these territories rebranded themselves as “Palestinians.”
Since then, every major offer for an independent Palestinian state has been rejected — six times. The dominant factions remain sectarian movements that refuse coexistence with Jews. Their violence has been continuous for over a century: intifada, jihad, terror campaigns, and political rejectionism.
Meanwhile, Arabs who stayed and fought alongside Jews in 1947–48 became Israeli citizens. Their families today are free, prosperous, and fully integrated — serving in government, professions, and the IDF.
The Palestinian leadership, largely operating from abroad, has kept its people in perpetual refugee status with the help of the UN, while siphoning billions in aid. The ideology of violent rejectionism has never relented.
