This concept encompasses the defense of Israel and its people. A milchemet mitzvah is not only permissible but necessary, says Rav Yisraeli, even if it entails significant risks to the lives of non-combatants and involves difficult military decisions. And according to Rav Yisraeli, \u201cwar with any nation threatening Israel is a milchemet mitzvah.\u201d<\/p>\n\n\n\n

The ongoing conflict with Hamas, and particularly the rescue of hostages, undoubtedly constitutes a milchemet mitzvah, as it represents an existential struggle for Israel\u2019s survival that is being keenly observed by all of Israel\u2019s adversaries. Which is why the cost of kidnapping Israelis must be high to deter such atrocities in the future. (It\u2019s a lot more relevant than, \u201cRemember the Sabbath day, the weekly day-of-resting, to sanctify it\u201d \u2013 USA citizens are privileged to have two days off every week, courtesy of workers\u2019 labor unions!)<\/p>\n\n\n\n

5 \u2013 No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.<\/p>\n\n\n\n

The Talmud relates that Rava, instantaneously aroused by a glimpse of her gorgeous body, rushed home to his wife for relief. The reason for this post is now as follows: \u201cWe learn so much about Rabbis [of the Talmud], the way they thought about things\u2026\u201d when we embrace the anti-feminism archetypes that are shared in many Rabbinical stories.<\/p>\n\n\n\n

For those who have read Talmud \u2013 but not studied Talmud \u2013 you probably had a visceral instant judgement about what this quoted sentence directly above (in the above paragraph) means.<\/p>\n\n\n\n

The Rabbis, the ancestral elders of Talmud writing times, they were chauvinistic and misogynistic, no? But, how well do you actually know you\u2019re ancestral elders?<\/p>\n\n\n\n

\u201cThe Rabbis almost consistently, but not always consistently, invoke these archetypes in order to deconstruct them\u2026 That this woman is way more complex than the one dimensional archetype that you took her to be.<\/p>\n\n\n\n

And the fact that you took her to be it [on plain reading of the story] ought to tell you something about the way you misread the characters in the text. \u2026 And, also, about the way you misread and mistreat the characters in your lives.\u201d \u2013 Gila Fine, Talmud scholar and lecturer of rabbinic literature at the Pardes Institute of Jewish Studies.<\/p>\n\n\n\n

The Talmud teaches that \u201cTorah scholars are similar to women. Rabbis are physically weak and delicate, just like women. Rabbis are indoor creatures, just like women. Rabbis are politically powerless, just like women\u201d [remember, it\u2019s the 2nd to 4th century CE].<\/p>\n\n\n\n

Likewise it is so \u201cfor the entire Jewish people. Rabbinic Judaism is created by men in a deeply patriarchal culture and, yet, it was very much created in the likeness of women.\u201d How so?!<\/p>\n\n\n\n

The Talmudic world is born out of statelessness and suffering, the loss of \u201cnational sovereignty. Jews were to others, what women were to men [in this time period]. They [Jews] were subordinate and defenseless [upon our own land]. They were politically disempowered and sometimes they were physically persecuted.\u201d The midrash teaches that \u201cthe pains of the people of Israel are like the pains of a woman during childbirth.\u201d<\/p>\n\n\n\n

For Jews who love embracing our Jewish Talmud, we know that, when we read a Rabbinical story, we must read it MORE than once. The first time is to appreciate every detail in the story, even if we find the subject matter distasteful or uncomfortable. Our elders presented this story for us to learn from, thus we must not read it just once. At least twice or, preferably, more.<\/p>\n\n\n\n

Any experienced Talmud reader knows that the teaching is not in the plain reading of the story. So, on the second reading, we must expand our vision and understand this story within the fuller context that surrounds it. A Rabbinic story is like a single verse in a poem. Truly understanding this verse can only be achieved by reading all the verses together. This is where we begin the act of learning from our ancestral elders.<\/p>\n\n\n\n

What Torah scholar Gila Fine does is she expands the action of comparison for understanding to a level where even the hidden emotions that are not overtly expressed in the story\u2019s reading are suddenly released, and the story that the Rabbis of the Talmud intended for you to digest is now self-evident. It is never enough to read or listen, hence why we Jews say, \u201cnow go study\u201d! So, do so.<\/p>\n\n\n\n
